At Intuition Therapy, LLC (“we,” “us,” or “our”) protecting your privacy is fundamental to our practice.  We are committed to safeguarding your information and explaining how we collect, use, and disclose your Personal Information related to your use of annabbeytherapy.com (the “Website”) and our services.  This Privacy Notice (the “Notice”) is intended to provide you with that information.

By providing us with your data, you warrant to us that you are over 13 years of age. 

Definitions

Personal Information, for purposes of this Notice, means information about an individual who can be identified from use of that information (or from that information when combined with other information in our possession or likely to come into our possession), including information that identifies, relates to, describes, is capable of being associated with, or could reasonably be linked, directly or indirectly, with a particular consumer or household.  Personal Information also includes any information identified as such in any applicable data privacy laws or regulations.  Personal Information does not include publicly available information from government records; de-identified or aggregated consumer information; or for purposes of this Notice, information specifically excluded from or by applicable data-privacy laws, such as the Health Insurance Portability and Accountability Act of 1996 (HIPAA), the Fair Credit Reporting Act (FRCA), the Gramm-Leach-Bliley Act (GLBA), and the Driver’s Privacy Protection Act of 1994.

Usage Data is data collected automatically that is either generated by your use of the Website or from the Website infrastructure itself (for example, the duration of your visit to a web page).

Cookies and Pixels are small data files that are placed on your computer or mobile device when you visit a website (cookies) and snippets of code that track use behavior on a website (pixels). Cookies and Pixels are used, for example, to make websites work or to make them work more efficiently.  Cookies and Pixels can also provide reporting information to track how a user interacts with a website.

Collection and Use of Personal Information

When you visit our Website, we may ask you to provide us certain Personal Information.  Other Personal Information may automatically be collected by our Website.  We do, however, limit our collection of Personal Information to information that we may use to perform the services described on our Website, which includes sending you information about our services, contacting you at your request, and providing you with the services described on our Website.  We will not collect additional categories of Personal Information or use the Personal Information we collected for materially different, unrelated, or incompatible purposes without providing you notice.  We currently collect the following categories of Personal Information from the sources and for the purposes indicated below:

·      Personal Identifiers, including your real name, telephone number, and email address.  We collect this information directly from you through your use of our Website or through your interactions with us so that we may provide you with our services and so that we can properly manage your client file, if applicable.

·      Sensitive Information, including the type of services in which you are interested and any additional information you choose to provide.  We collect this information directly from you through the contact form on our Website, and we use it solely for the purpose of providing you with our services.

·      Sensitive Information, Characteristics of Protected Classifications, Commercial Information, Biometric Information, Professional or Employment-Related Information, and Education Information, including (for example and where applicable), your race, religion, sexual orientation, gender identity or expression, hair color, eye color, place and nature of employment, and educational history.  We do not collect this information through our Website.  Where necessary to provide you with our services, we collect this information directly from you through your interactions with us solely for the purpose of providing you with our services.

·      Internet Activity and User Data, including your interaction with the Website, the type of browser and device you use, access times, pages viewed (including the web pages you visited prior to visiting our Website), your Internet Protocol Address, and any data that you post for publication on our Website or through other online services.  We collect this information directly from you through your use of our Website, including through use of Cookies and Pixels as discussed further below, so that we may provide you with our services, to improve the Website and present its contents to you, and to protect the Website, including for backup purposes.  We may also use this information to measure or understand the effectiveness of our advertising, to grow our business, and to determine our marketing strategies

·      Communication Data, including any communication that you send to us, whether through the contact form on our Website, through email, text, social media messaging, social media posting, or any other communication that you send us.  We use this information to communicate with you and to provide you with our services.

·      Marketing Data, including information about your preferences in receiving marketing from us and our third parties and your communication preferences. We process this data to enable you to determine your communication preferences and to deliver relevant website content and advertisements to you and to measure or understand the effectiveness of this advertising, to grow our business, and to determine our marketing strategies.

Please note that where we are required to collect Personal Information by law, or under the terms of a contract between us, and you do not provide us with that information, we may not be able to provide our services to you. If you do not provide us with the requested Personal Information, we may have to cancel a service you have requested, but if we do, we will notify you at the time.

Collection and Use of Data from Minors

We comply the requirements of COPPA (Children’s Online Privacy Protection Act). We do not knowingly collect any information on this Website from anyone under 13 years of age. Our Website is directed to people who are at least 13 years old or older. We recommend that anyone under 18 years of age use our Website only with parental permission and supervision. We do not intend to collect any Personal Information through our Website from children under the age of 18. If a parent or guardian of a child who has provided us with such Personal Information would like the information deleted from our records, he or she should contact us at the email address listed at the bottom of this Notice. We will then delete the child’s Personal Information from our files.

If we become aware that Personal Information regarding a child under the age of 13 has been collected through the Website, we will use such information for the sole purpose of contacting a parent or guardian of the child to obtain verifiable parental consent. If we cannot obtain consent after a reasonable time, or if when contacted a parent or guardian requests that we do not use or maintain such information, we will make reasonable efforts to delete it from our records. Upon request by a parent or guardian, we will provide a description of the specific types of Personal Information collected from a child who is under the age of 13.

You can set your browser to refuse all or some browser cookies, or to alert you when websites set or access cookies. If you disable or refuse cookies, please note that some parts of this Website may become inaccessible or not function properly.   

At this time, we do not respond to DNT (Do Not Track) signals.

Non-Personal Information

This Notice does not restrict our collection, use, or disclosure of any aggregated information or information that does not identify, or cannot be reasonably linked to, any individual.

Disclosure and Sharing of Personal Information with Service Providers

We may disclose Personal Information we collect from you or from the categories of sources described above: (1) to contractors, service providers, and other third parties we use to support our business; (2) to fulfill the purpose for which you provide it; (3) to a buyer or other successor in the event of a sale or transfer of some or all of our business or assets; (4) for any other purpose disclosed by us when you provide the information; (5) to comply with any court order, law, or legal process, including responding to any government or regulatory request; (6) if we believe disclosure is necessary or appropriate to protect the rights, property, or safety of us, our clients, or others; or (7) for additional purposes with your consent. We do not sell or otherwise share Personal Information with third parties for direct marketing purposes. And when we do share your information with our service providers, they are contractually prohibited from retaining, using, or disclosing your Personal Information for any purpose other than that specified in the contract.

The information we collect is currently shared with the following categories of providers or the specific providers listed for the purposes set forth below:

·      Personal Identifiers, including your real name and email address.  This information is shared with Squarespace, our email marketing provider, so that we can send you marketing emails as described below.

·      Internet Activity and User Data, including information about your browser, network, and device, web pages you visited prior to coming to this website, your IP address, information about your use of this Website, including clicks, internal links, pages visited, scrolling, searches, and timestamps.  This information is shared with Squarespace, our website analytics provider and our Website host, to learn about site traffic and activity and to run the Website and to protect and improve its platform and services.  Squarespace analyzes the data in a de-personalized form. 

Additionally, this website uses font files from Google Fonts and Adobe Fonts. To properly display this site to you, servers where the font files are stored may receive personal information about you, including information about your browser, network, or device and your IP address

Further, to provide you with the Website, we must communicate with certain third parties.  These third-party providers may also have privacy policies that differ from ours.  For example, they may collect personal information about your online activities over time and across different websites and other online services, and they may use this information to provide you with interest-based (behavioral) advertising or other targeted content.  We do not control these third-parties or their privacy practices, and this Notice does not apply to any third-party website or service you may access through our website.  If you have any questions about a third-party provider’s privacy policies or advertising, you should contact the responsible provider directly.  Third-Party Providers we use include:

·      Square Capital, LLC.  Our appointment scheduling and payment processing are supported by Square Capital, LLC.  For more information on Square’s privacy policies, visit https://squareup.com/us/en/legal/general/privacy.

Email Marketing

We may send you marketing communications if (i) you made a purchase or asked for information from us about our goods or services or (ii) you agreed to receive marketing communications, and in each case you have not opted out of receiving such communications. We share your contact information with Squarespace, our email marketing provider, so that Squarespace can send these emails on our behalf. You may opt out of receiving marketing emails from us at any time. 

We will not share your Personal Information with any third party for such third party’s own marketing purposes without your express consent.  

Retention of Information

We will retain your Personal Information only for as long as is necessary for the purposes set forth herein.  Further, we may retain and use your Personal Information to the extent necessary to comply with our legal obligations (for example, if we are required to retain your data to comply with applicable laws), resolve disputes, and enforce our legal agreements and policies. When deciding how long to retain such information, we look at its amount, nature, and sensitivity, potential risk of harm from unauthorized use or disclosure, the processing purposes, and whether these can be achieved by other means and legal requirements. 

We will retain your Usage Data for internal analysis purposes. Usage Data is generally retained only as long as necessary to properly analyze the data, to strengthen the security or to improve the functionality of our Website, or if we are legally obligated to retain this data for longer time periods.

Data Processing

Your information, including Personal Information, may be transferred to — and maintained on — computers located outside of your state, province, country, or other governmental jurisdiction, where data protection laws may differ than those from your jurisdiction.

If you are located outside of the United States and choose to use the Website, please note that we transfer the data, including Personal Data, to the United States and process it there.  Your consent to this Privacy Notice followed by your use of the Website represents your agreement to that transfer.

We will take all steps reasonably necessary to ensure that your data is treated securely and in accordance with this Privacy Notice and that no transfer of your Personal Information will take place to an organization or a country unless there are adequate controls in place including the security of your data and other personal information.

Data Security

We have implemented measures designed to secure your information from accidental loss and from unauthorized access and disclosure. The use of, and access to, your Personal Information by us is restricted to employees and contractors who need to know that information to provide services to you. We maintain physical, electronic, and procedural safeguards to limit access to your Personal Information.  Unfortunately, transmission of information via the Internet is not completely secure. Although we do our best to protect all information submitted to our Website, we cannot guarantee the security of any such information.  Any electronic transmission of information is at your own risk.  We do, however, have procedures in place to deal with any suspected breach of Personal Information and will notify you and any applicable regulator of a breach if we are legally required to do so.

We will post any changes we make to this Privacy Notice on our website. If we make material changes to how we treat Personal Information we collect from you, we will notify you on our Website homepage. The date this Privacy Novice was last revised is identified above.
